Privacy Policy
Welcome to Wealth Genie (available through the WealthNX.ai platform at https://www.wealthnx.ai/), an AI-enabled messaging and analytics environment ("Wealth Genie" or the "Platform") that provides users with various tools and features (the "Services"), each as described more completely under the WealthNX.ai Terms and Conditions (at https://wealthnx.ai/terms-and-conditions). The Platform and the Services consist only of software made available to users ("you" or "your") by Inexor Inc. (including its operators and affiliates, "we," "our," or "us") subject to the WealthNX.ai Terms and Conditions and this Privacy Policy (this "Policy," at https://wealthnx.ai/privacy-policy). By registering for, accessing, or using the Platform or the Services, whether or not you do so on behalf of any other person or entity, you hereby accept and agree to be bound by this Policy.
This Policy applies to all access to and use of the Platform and the Services, including through any websites, mobile or desktop applications, application programming interfaces (APIs), integrations, beta or pre-release environments, data feeds, analytics tools, communications, or other digital properties or services operated, maintained, or controlled by us that link to or reference this Policy.
1. Your Personally Identifiable Information
1.1 Personal Information Collected
We collect information that you voluntarily provide via the Platform, when using or accessing the Services, when connecting any third-party accounts, or in connection with your interactions with our partners or suppliers or with Third-Party Providers (as that term is defined under the WealthNX.ai Terms and Conditions). The information you submit might include your name, company information, street address, email address, phone number, and, in some cases as might be collected by Third-Party Providers, social security number or other tax ID number. We consider this information to be your personally identifiable information (your "PII"). Unless we have your complete street address or otherwise unless such information can be reasonably linked to you personally, we do not consider your city, state, ZIP code, or general geographic location (including as it might be deduced based on your IP address) to be your PII. We collect information about the devices, software, and networks you use to access the Platform or the Services (including but not limited to IP address, unique device or session identifiers, device type, operating system, browser or client, referral URLs, session timestamps, feature usage metrics, system activity logs, performance data, error reports, audit logs, security events, and crash diagnostics). While we do not generally consider such information to constitute your PII, certain elements of this information may be considered "Personal Information" or "Personal Data" under applicable state, federal, or international privacy or data protection laws. We also may collect the content of messages, prompts, file attachments, and AI model context that you submit using the Platform or the Services, as well as the outputs provided to you by the Platform or the Services. Users retain ownership of content, prompts, files, account information, and other information submitted through the Platform and Services. WealthNX receives only the limited rights necessary to provide, operate, maintain, secure, support, and improve the Services as described in the Terms and Conditions. We may collect financial account information authorized by users, including account balances, transaction histories, holdings, positions, investment performance information, linked account metadata, and digital asset wallet information. We may also collect information about you from other sources, including from our affiliates, partners, service providers, analytics providers, security and fraud-prevention providers, publicly available sources, and third parties with whom you have authorized a connection, integration, or data sharing arrangement. We may combine such information with information we collect directly from you or automatically through your use of the Platform or the Services.
1.2 Use of Your Personal Information
Your PII might be shared with Third-Party Providers, between us and our partners or suppliers, or to other entities based on any separate requests you might make to us. When you provide PII like your phone number or email address, such as when registering for an account to use or access the Platform or the Services, we may use it to reach you to fulfill your request, answer your questions, or obtain or associate additional information about you or your organization. We may use information described in this Policy, including your PII, to customize or enhance your experience on the Platform or when using or accessing the Services, provide you with information on or access to our products or services or those of our partners or suppliers, or to communicate with you about those products or services. We may use this information to operate, maintain, secure, and optimize the manner in which the Platform and the Services operate. We may also aggregate and use this information to produce reports, analytics, research, and internal business insights for our own purposes. We may further use your information as reasonably necessary to comply with applicable laws, regulations, legal processes, and governmental requests; to enforce the WealthNX.ai Terms and Conditions and other agreements; to detect, prevent, investigate, and respond to fraud, misuse, security incidents, or other harmful or unlawful activity; and to protect the rights, property, or safety of us, our users, or others. We do not sell your PII to third parties, and we do not otherwise make commercial use out of your PII other than for business purposes directly related to supporting the provision of the Platform or the Services to you or as otherwise specified above.
1.3 Disclosure of Your Personal Information
We may disclose whatever information described in this Policy, including your PII, without first providing you additional notice or obtaining your consent, to (a) third-party service providers, consultants, advisors, auditors, and professional firms that provide advice, products, or services to us, or that help us operate, secure, or improve the Platform, the Services, or any other of our services, features, or content (or those of our partners or suppliers) and their value to users of the Platform or the Services; (b) a potential acquirer, successor, or other participant in connection with any merger, acquisition, reorganization, financing, bankruptcy, dissolution, or sale of all or substantially all of our business assets; (c) regulators, law enforcement authorities, courts, government agencies, or other third parties to whom disclosure of your information is required or permitted by applicable law, regulation, subpoena, court order, or legal process, or that is reasonably necessary to enforce or take appropriate action under the WealthNX.ai Terms and Conditions or other agreements; or (d) other third parties when reasonably necessary to detect, prevent, or respond to fraud, misuse, security incidents, or to protect the rights, property, or safety of us, our users, the Platform, the Services, or our partners and suppliers. We may also disclose your PII to social media companies or to Third-Party Providers (such as when linking your account with a bank, brokerage, digital asset exchange, or other provider) in an encoded (or "hashed") format that can only be recognized if you have an account on such companies' platforms or with such Third-Party Providers. We only disclose your PII to those of our partners, suppliers, or other service providers with appropriate controls for handling and protecting your PII, or otherwise to those Third-Party Providers whom you authorize to make a connection to the Platform or the Services. Except for Third-Party Providers to whom you separately authorize a connection or linked account, we may impose contractual obligations on service providers to ensure they only use your PII in accordance with applicable law as necessary to provide services to us or you. When users choose to connect financial accounts through Plaid or another account connectivity provider, information may be transmitted to and received from such providers solely for purposes of providing the Services. Where applicable, WealthNX seeks to process consumer-authorized financial account information in a manner consistent with applicable consumer financial data access requirements, including CFPB Section 1033 and related implementing regulations.
1.4 Your Geolocation Information
When you access or use the Platform or the Services, we may use cookies to discern your general geolocation information from the IP address associated with your computer or mobile device. We use this information to support general analytics, business, and communications functions, and to help discern your location within or connection to any jurisdiction that might be restricted under the WealthNX.ai Terms and Conditions. You may stop our collection of your geolocation information by ceasing use of or access to the Platform or the Services and by cancelling or terminating your account in accordance with the WealthNX.ai Terms and Conditions. We also reserve the right to block or restrict your access to the Platform or the Services for any reason (such as on the basis of your IP address or otherwise as provided in the WealthNX.ai Terms and Conditions) and may reject any request to register for an account or access or use the Platform or the Services if we are unable to confirm your location.
1.5 Your Responses to Surveys or Emails
We may from time to time administer, or work with a third party to administer, surveys to users of the Platform or the Services, or to visitors of any website or social media profile under our control to aid us in better targeting our ideal online audience, better serve our users, and improve the Platform, the Services, or other related or unrelated products, services, or features. Additionally, if you are receiving emails in connection with your use of or access to the Platform or the Services or other communications from us requesting information in connection with your use of or access to the Platform or the Services, then you may opt out of receiving non-essential or non-administrative communications by selecting "unsubscribe" at the footer of those communications, or by requesting to opt out in writing by delivering an email to WealthNX.ai support at support@wealthnx.ai.
1.6 How Long We Keep Your Information
If you register an account through the Platform, make any payment to us, agree to any recurring subscription for the Platform or the Services, or register for any other related or unrelated product, service, or feature provided by us or any of our partners or suppliers, then we will retain your PII for at least as long as you maintain your account or active registration. If you close all your accounts, subscriptions, or registrations with the Platform and the Services, then we will continue to hold records of your PII for as long as necessary to comply with all applicable laws, regulations, or internal policies. We may additionally hold your PII for so long as necessary to adequately respond to any questions, complaints, or claims made by you, your organization, or someone else on your behalf, and to show that we have treated you fairly. We will not keep your PII for longer than necessary for the purposes identified in this Policy and, at the end of the applicable retention period or within a reasonable period consistent with applicable law and our retention obligations, will delete or anonymize your information. If you voluntarily publish or submit any of your PII or other information on any public space (such as on any website or social media profile under our control), as part of any Feedback (as that term is defined in this Policy), or in any message, forum, publication, broadcast, or screening, then you do so at your own risk, and your information could very well persist online indefinitely if you do not remove that information or specifically ask us to remove it in writing and in accordance with the terms of this Policy.
1.7 Your Participation in Beta Software Testing
If you are accessing or using the Platform or the Services in any beta environment or in connection with any testing, then you shall timely provide feedback, including but not limited to bug reports, disclosure of actual or suspected errors or defects, and written evaluations of new features included as part of any beta software ("Feedback"), to us or to our partners or suppliers via the official channels designated by us. In providing Feedback, you agree to provide material, statistics, written statements, and other data and information that is not considered confidential to you or any company you might represent. All Feedback is exclusively our property, and we may use such Feedback for any purpose in our discretion, including but not limited to informing improvements to the Platform or the Services or for use in press releases, public statements, user testimonials, or other business or marketing materials. We will own and retain all right, title, and interest in and to your Feedback, as well as the intellectual property rights in the Platform, the Services, and the underlying beta software (including but not limited to any derivative works thereof), subject only to the limited license expressly set forth in the WealthNX.ai Terms and Conditions. You do not acquire or retain any other rights, either express or implied or in whole or in part, in the Feedback or the Platform, the Services, or the underlying beta software.
1.8 Contents of Feedback Submitted During Beta Software Testing
You agree that Feedback does not and will not (a) contain or be recompilable into your PII or the PII of any third parties (including but not limited to financial data, account information, or other personal information), (b) contain your or your company's original ideas or inventions or be provided to us subject to payment or conditions, (c) once conveyed to us, be considered the property or confidential information of anyone other than us, or (d) be used or distributed to any other persons or entities or for any other purpose except within our sole and absolute discretion. All rights not expressly granted hereunder or under the WealthNX.ai Terms and Conditions are reserved to us. If you do transmit to us or our partners or suppliers by any means or by any media any materials or other information (including but not limited to PII, ideas, concepts, or techniques for new or improved services and products), whether as Feedback or other information, data, questions, comments, suggestions, or otherwise, then you do so at your own risk. Although as reasonable we will work to remove or otherwise protect any PII you include such submissions in violation of this Subsection 1.8, you agree that such submissions could go unrestricted and might not be considered confidential or proprietary information or PII of any kind unless and until you identify to us the details of your mistaken disclosure, and you accordingly automatically grant us and our assigns a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license, with the right to sublicense, copy, transmit, distribute, create derivative works of, display, or otherwise use such information for any purpose and within our sole and absolute discretion.
1.9 Data Security and Safeguards
We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and security of Personal Information and Personal Data that we collect, store, or process. These safeguards include, where appropriate, access controls, encryption, network security measures, monitoring, logging, and employee training. No method of transmission over the Internet or method of electronic storage is completely secure. Accordingly, although we strive to protect your information, we cannot guarantee its absolute security. You acknowledge and agree that you provide your information to us at your own risk. In the event of a suspected or confirmed data security incident involving Personal Information or Personal Data, we will investigate the incident and take reasonable steps to mitigate potential harm. Where required by applicable law, we will provide notice to affected individuals and relevant authorities within the timeframes prescribed by law.
1.10 International Data Transfers
The Platform and the Services are operated from the United States. If you access or use the Platform or the Services from outside the United States, you acknowledge and agree that your information, including Personal Information and Personal Data, may be transferred to, processed, and stored in the United States or other jurisdictions where we, our partners, suppliers, or service providers maintain facilities. Such jurisdictions may have data protection or privacy laws that differ from those in your place of residence. We take reasonable steps to ensure that appropriate safeguards are in place to protect your information in accordance with this Policy and applicable law, including through contractual protections with service providers where required.
1.11 Automated Processing, AI Outputs, and No Professional Advice
Certain features of the Platform and the Services rely on automated processing, artificial intelligence models, algorithms, and machine learning techniques to generate outputs, analyses, insights, predictions, or recommendations. Any outputs provided through the Platform or the Services are generated automatically based on the information made available to the system and may be incomplete, inaccurate, outdated, or inappropriate for your specific circumstances. Outputs are provided for informational and analytical purposes only and do not constitute legal, financial, investment, tax, accounting, or other professional advice. Such outputs should not be interpreted as investment recommendations, securities recommendations, trading signals, or portfolio management advice. You are solely responsible for evaluating and verifying any outputs before relying on them. We do not make any representations, warranties, or guarantees regarding the accuracy, completeness, reliability, or suitability of any automated outputs, and we disclaim any liability arising from your use of or reliance on such outputs, to the maximum extent permitted by applicable law.
1.12 Artificial Intelligence Processing
Certain features of the Platform and Services rely upon artificial intelligence, machine learning technologies, and automated analytical systems operated by WealthNX and authorized service providers. Information submitted through the Services, including prompts, uploaded content, linked account information, and related contextual information, may be processed by such systems solely for the purpose of providing the Services. Unless expressly disclosed and authorized, WealthNX does not use user financial information, linked account information, prompts, or content submitted through the Services to train proprietary artificial intelligence models for unrelated commercial purposes.
1.13 Regulatory Framework
This Policy is designed to support WealthNX's commitment to operating its artificial intelligence systems in a manner consistent with applicable legal and regulatory requirements and guidance. WealthNX designs, implements, tests, monitors, and governs AI-enabled features with reference to, and where applicable in a manner intended to support compliance with, the following regulatory frameworks:
- Section 202(a)(11) of the U.S. Investment Advisers Act of 1940, relating to the definition of investment adviser activity;
- Rule 206(4)-1 under the Investment Advisers Act of 1940 (the SEC Marketing Rule), relating to advertising, endorsements, testimonials, and performance-related communications;
- FINRA Rule 2210, relating to communications with the public and standards governing fair, balanced, and non-misleading communications;
- The U.S. Securities and Exchange Commission's proposed Predictive Data Analytics and Conflicts of Interest rules, together with related SEC guidance, risk alerts, examination priorities, and public statements concerning the use of predictive analytics, artificial intelligence, and optimization technologies in investor-facing products;
- Section 501(b) of the Gramm-Leach-Bliley Act (GLBA) and related information security and safeguarding requirements; and
- Section 1033 of the Consumer Financial Protection Act and related Consumer Financial Protection Bureau regulations concerning consumer-authorized financial data access and sharing.
This Policy shall be interpreted and administered in a manner intended to support compliance with the foregoing authorities, as applicable to the Platform, the Services, and WealthNX's business activities.
1.14 Third-Party Websites, Platforms, and Services
The Platform and the Services may contain links to, integrate with, or enable access to third-party websites, platforms, applications, content, or services that are not owned or controlled by us ("Third-Party Services"). This Policy applies solely to information collected by us through the Platform and the Services. We do not control, and are not responsible for, the privacy practices, data handling, security, or content of any Third-Party Services. Your interactions with Third-Party Services, including the submission of information to them, are governed by their respective privacy policies and terms, not this Policy. We encourage you to review the privacy policies and terms of any Third-Party Services before providing them with your information or enabling integrations with the Platform or the Services.
2. Cookies
2.1 What Cookies Are
To ensure optimal performance and support your ability to use and access the Platform and the Services, we and our partners or suppliers, as well as other third parties, may install and use cookies. Cookies are small text files generated when you access the Platform or otherwise use or interact with the Services and are used to collect your internet browsing information. All cookies that we use are safe for your device and only process the information stored on your browser. These cookies cannot execute code, do not contain malware or viruses, and cannot be used to access content stored on your device.
2.2 How We Use Cookies
The use of cookies in connection with providing the Platform and the Services are critical or otherwise broadly integral to the performance of the Platform and the Services. We may also use certain non-essential cookies or similar tracking technologies for things like (a) analytics, to understand how you interact with the Services, (b) security, to detect fraud or misuse, and (c) optional purposes, such as personalization or marketing.
2.3 Blocking or Deleting Cookies
If you would like to reject cookies, or if you would like to remove the cookies to which you previously consented, then you can modify your browser settings to block or delete cookies. The means by which you may refuse cookies in your web browser settings could vary depending on the browser or device you use (see e.g., Instructions for Clearing and Managing Cookies in Google Chrome, available at https://support.google.com/chrome/answer/95647). See your web browser's help menu for more information. If you choose to block or refuse any cookies that are essential to core functionality, then the Platform or the Services could become inaccessible, render them inoperable, or otherwise materially affect or hinder their performance.
2.4 Do Not Track and Global Privacy Control Signals
Some web browsers and devices permit users to enable "Do Not Track" signals or Global Privacy Control ("GPC") signals. At this time, except as may be required by applicable law, the Platform and the Services do not respond to or honor Do Not Track signals. Where required by applicable law, including under the California Consumer Privacy Act and related regulations, we recognize and process valid Global Privacy Control signals as a request to opt out of the sale or sharing of Personal Information, where applicable.
3. Information Collected Through Other Technologies
3.1 Web Beacons
From time to time, we may use other tracking technologies similar to cookies called "web beacons" (or "tracking pixels" or "clear gifs") to monitor traffic patterns on the Platform or between various features associated with the Services and to deliver or communicate with cookies. Web beacons are small graphics that display a unique identifier that allow us to recognize when someone has visited the Platform or opened an email from us. Web beacons help us to improve the performance of the Platform and the Services and understand whether any particular visit to the Platform is directed from certain external sources, like from a publication displayed on a third-party platform application or website or an email announcement or other content distribution. Web beacons are largely reliant on cookies to function properly, so blocking or rejecting cookies can impair web beacon functionality and, in turn, the performance or efficiency of the Platform or the Services.
3.2 Local Storage and Similar Technologies
From time to time, we may use browser-based local storage or other similar technologies (for example, HTML5 local storage, Indexed DB, or other local data caching mechanisms supported by your browser or device) to collect and store limited information about your use of the Platform and the Services, to remember your settings and preferences, to prevent fraud or misuse, and to support other operations. These technologies store data locally on your device and are typically managed through your browser or device settings rather than through "Flash" or Adobe Flash Player, which is now deprecated and no longer used by the Platform. If you do not want us to store information using these local storage technologies, you can configure your browser or device to limit or disable local storage features where supported; however, doing so may impair the functionality or performance of some aspects of the Platform or the Services.
3.3 Targeted Advertising
Third-party companies may use web beacons or other technologies in connection with your use of your device to send or display advertisements to you, but we do not enable targeted advertising on, through, or in connection with the Platform or the Services.
4. Important Restrictions
4.1 Geography
Use of and access to the Platform and the Services is restricted to persons and entities domiciled within one of the 50 states of the United States or the District of Columbia. If you are located in any non-U.S. jurisdiction or in any U.S. territory or possession, then you must not visit, access, or use the Platform or the Services or register an account with us, and you must not use a VPN or deploy any other methods to obscure your geographic location in an attempt to circumvent geographic-based restrictions or controls we might impose in connection with the Platform or the Services. If you are located or domiciled in any of the following U.S. states, see Section 5 of this Policy for additional disclosures about your rights and our collection and use of your personal information under applicable state laws: California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Jersey, New Hampshire, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia.
4.2 Children's Privacy
The Platform and the Services are directed to a specific audience but not at children under the age of 18. We do not knowingly collect or solicit personal information from any person under the age of 18 or knowingly allow them to use or interact with the Platform or the Services. If you are under 18, you must not visit, access, or use the Platform or the Services, register an account with us, or participate in or attend any forum, discussion, or event in connection we might host, whether or not hosted in connection with the Platform or the Services. If we obtain actual knowledge that the personal information of a child under age 18 was or is being collected through the Platform or the Services, then we will delete that information as quickly as possible. If you believe we might have collected any information from or about a child under 18, then please contact us immediately by email at support@wealthnx.ai.
5. Supplemental Privacy Notices
5.1 California Residents
Under the California Consumer Privacy Act (CCPA) and as used in this Subsection 5.1 of this Policy, "Personal Information" means information that identifies, relates to, or describes a particular consumer or household, or that is reasonably capable of being associated with or could be reasonably linked to, directly or indirectly, a particular consumer or household. Personal Information does not include any of the following: (a) publicly available information from government records; (b) aggregated or anonymized data that is not capable of being associated with you; (c) information related to job applicants, attorneys, employees, contractors, or other WealthNX personnel; (d) certain information that WealthNX may process solely on behalf of its clients; and (e) information covered by certain applicable sector-specific state or federal privacy laws, including the U.S. Fair Credit Reporting Act, the U.S. Gramm-Leach-Bliley Act, the U.S. Health Insurance Portability and Accountability Act of 1996, the U.S. Driver's Privacy Protection Act of 1994, and the California Financial Information Privacy Act.
The Personal Information that we may collect includes (1) individual identifiers (like names, street addresses, email addresses, and other similar information), (2) California customer records (including records identifying you, such as by your name, personal physical characteristics, signature, telephone number, passport or other government identification number, education or employment history, and credit or other financial history), (3) other professional records (like business and employment records or other professional information, such as your current occupation, job title, employer, and industry), (4) commercial information (including information about your or your organization's commercial activities), (5) other personal information (such as Personal Information that might be identified as part of any question, request, offer, solicitation, or other communication you make to us via our websites or the Platform, through social media, or any other means of public communication, which could potentially be gathered from public sources), (6) cookies and other network information (including information generated from your use of the Platform or the Services on browser and internet use, such as analytics data on your activity, which may be collected from your browser or device through the use of cookies), (7) geolocation information (such as based on log data collected from your browser or device), (8) sensory information (including any notes, document files, recordings, or other data submitted as inputs when using the Platform or the Services), and (9) financial account information (including account balances, transaction histories, holdings, positions, linked account information, account performance information, and digital asset wallet information).
In the last 12 months, we have only used the above categories of Personal Information for the uses identified in this Policy and have not sold any Personal Information about you but may have disclosed Personal Information of any of the above categories to our partners or suppliers for a professional business purpose. Although we never "sell" your Personal Information, we may occasionally disclose your Personal Information to certain of our partners or suppliers for business purposes as necessary to (i) assess and improve the Platform or the Services or (ii) detect, stop, and report fraudulent activities.
As a California resident, you could be eligible to exercise any of the following rights in relation to the Personal Information that we collect, subject to certain limitations under applicable law:
Your Right to Know
You have the right to request from us any or all of the following in relation to any Personal Information that we might have collected about you or disclosed in the last 12 months: (i) the specific information or data points we have collected from or about you; (ii) the categories of Personal Information we have collected from or about you; (iii) the general sources of the Personal Information we have collected from or about you; (iv) the categories of Personal Information we have disclosed about you to third parties for business purposes, as well as the types of third parties to whom we disclosed that Personal Information; (v) the categories of your Personal Information that we have sold (which is none), and the types of third parties to whom we sold that Personal Information; or (vi) the business purposes for which we have collected and used your Personal Information. To exercise your right to know, submit a written request to us by emailing support@wealthnx.ai with the subject "California Rights Request." In your email, identify each of the above categories on which you are seeking information. We will need to verify your identity before processing your request, such as by requiring you to log into your account or matching sufficient information provided by you with the information maintained in our systems (which could necessitate requesting additional Personal Information from you). We may in certain circumstances deny your request, particularly if we are unable to verify your identity.
Your Right to Request Deletion
You have the right to request deletion of Personal Information that we have collected from you, subject to certain exceptions, such as if we continue to provide the Platform, the Services, or other products or services to you or your organization or we are required by law or internal policy to retain your Personal Information. To exercise your right to request deletion, submit a written request to us by emailing support@wealthnx.ai with the subject "California Rights Request." In your email, identify what Personal Information you would like us to delete to the extent possible. We will need to verify your identity before processing your request, such as by requiring you to log into your account or matching sufficient information provided by you with the information maintained in our systems (which could necessitate requesting additional Personal Information from you). We may in certain circumstances deny your request, particularly if we are unable to verify your identity.
Your Right to Opt Out of Information Sales
You have the right to request that we not sell your Personal Information to third parties, now or in the future. As indicated above, we never "sell" your Personal Information to any third parties for purposes of the CCPA, and our partners or suppliers who might have access to some Personal Data are generally prohibited from selling this information (other than in anonymized or aggregated form) to third parties. If, as a result of exercising your right to know, we identify third parties or types of third parties to whom we might have disclosed your Personal Information, then you should direct any requests exercising your right to opt out of information sales directly to those third parties.
Your Right to Non-Discrimination
You have the right to not be discriminated against in any way for exercising any other rights above, provided such rights are afforded to you under the CCPA.
5.2 Residents of Other Applicable U.S. States
As used in this Subsection 5.2 of this Policy or otherwise materially comparable to some other statutorily defined term or phrase under the consumer privacy or data protection laws of various certain other states (including Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Jersey, New Hampshire, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia), "Personal Data" means information that is linked or reasonably linkable to an identified or identifiable natural person, but it does not include aggregated or "de-identified" data or publicly available information. Personal Data also does not include (a) information related to job applicants, employees, contractors, or other of our personnel or those of our partners or suppliers, (b) certain information that we may process solely on behalf of our partners or suppliers, or (c) information covered by certain applicable sector-specific state or federal privacy laws, including the U.S. Fair Credit Reporting Act, the U.S. Gramm-Leach-Bliley Act, the U.S. Health Insurance Portability and Accountability Act of 1996, and the U.S. Driver's Privacy Protection Act of 1994.
The Personal Data that we may collect includes (1) individual identifiers (like names, street addresses, email addresses, and other similar information), (2) professional records (like business and employment records or other professional information, such as your current occupation, job title, employer, and industry), (3) commercial information (including information about your or your organization's commercial activities), (4) internet and other network-related information, (5) geolocation information, (6) sensory information, (7) inferential information, and (8) financial account information (including account balances, transaction histories, holdings, positions, linked account information, account performance information, and digital asset wallet information.
In the last 12 months, we have only used the above categories of Personal Data for the uses identified in this Policy and have not sold any Personal Data about you but may have disclosed Personal Data of any of the above categories to our partners or suppliers for a professional business purpose.
As a resident of any state covered by this Subsection 5.2 of this Policy, you could be eligible to exercise any of the following rights in relation to the Personal Data we collect, subject to certain limitations under applicable law and only if and as available under the state's applicable consumer privacy or data protection statutes:
Your Right to Confirm and Access
You have the right to request that we confirm, in writing, whether we have processed any of your Personal Data. You also have the right to access the Personal Data we have collected from or about you.
Your Right to Request Deletion
You have the right to request deletion of Personal Data we have collected from you, subject to certain exceptions, such as if we continue to provide the Platform, the Services, or other products or services to you or your organization, or when we are required by law or internal policy to retain your Personal Data.
Your Right to Correct Inaccuracies
You have the right to request that we correct inaccurate Personal Data we have about you, taking into account the nature of the category of Personal Data and the purposes for its processing.
Your Right to Opt Out of Processing for Targeted Advertising
You have the right to opt out of the processing of your Personal Data for purposes of targeted advertising.
Your Right to Opt Out of Data Sales
You have the right to request that we not sell your Personal Data to third parties, now or in the future. As indicated above, we never "sell" your Personal Data to any third parties for purposes of state data privacy laws, and our partners or suppliers who might have access to some Personal Data are prohibited from selling this information (other than in anonymized or aggregated form) to third parties.
Your Right to Opt Out of Profiling
You have the right to opt out of the processing of your Personal Data for profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
Your Right to Obtain a Copy of Your Personal Data
You have the right to obtain a copy of your Personal Data that you previously provided to us.
Your Right to Non-Discrimination
You have the right to not be discriminated against in any way for exercising any other rights above, provided such rights are afforded to you under the data privacy law applicable in your state.
5.3 Exercising Your State-Specific Rights
To exercise any rights afforded to you in the state where you are domiciled and in connection with Subsection 5.1 or 5.2 of this Policy, please submit a written request to us by emailing support@wealthnx.ai with the subject "<insert your state> Rights Request." In your email, be as specific as possible identifying each of the categories or specific pieces of Personal Data or Personal Information relevant to your request. We will likely need to verify your identity before processing your request, such as by requiring you to log into your account or matching sufficient information provided by you with the information maintained in our systems (which could necessitate requesting additional Personal Data or Personal Information from you). We may in certain circumstances deny your request, particularly if we are unable to verify your identity, of which we will notify you in an email or other form of electronic communication. If we decline to take action regarding a privacy request, you may appeal our decision by submitting a written appeal to support@wealthnx.ai. We will review and respond to such appeal in accordance with applicable law.
6. Changes to This Privacy Policy
We may update or modify this Privacy Policy from time to time in our sole discretion to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes to this Policy, we will update the "Last updated" date at the top of this Policy and, where required by applicable law, provide additional notice through the Platform, by email, or by other reasonable means. Your continued use of or access to the Platform or the Services after any changes to this Policy become effective constitutes your acknowledgment of the updated Policy and your agreement to be bound by its terms.
